1.About these terms

These terms form an agreement between you and Central Mart (“we”, “us”, “our”) covering your use of our website and any related pages or services where you can browse and buy groceries and other goods from us.

We may update these terms from time to time. When we do, we will change the “Last updated” date at the top of this page. If you keep using Central Mart after a change, you accept the new version. Changes do not affect orders you already placed.

2.Who can use Central Mart

You must be at least 18 years old to create an account or place an order. If you are younger, a parent or guardian must place orders for you.

By using the site you confirm that you are allowed to enter into this agreement and that you will follow the laws of Kenya.

We try to show products accurately, but photos, colours and descriptions on a screen may differ slightly from the real item.

All items are sold subject to availability. An item may run out, or we may stop selling it, at any time. Prices are in Kenya shillings (KES) and may change. The price you pay is the price shown when you place your order.

If we find a pricing or listing mistake, we may correct it. If this affects an order you already placed, we will contact you and you may choose to continue at the correct price or cancel.

5.Orders

Placing an order is an offer to buy. It becomes confirmed once we accept it, which for M-PESA orders happens after your payment is received.

We may refuse or cancel an order, or limit quantities per person, household or order, for example if an item is out of stock, an address cannot be reached, or an order looks like it is for resale. If we cancel an order you already paid for, we will refund you.

6.Payment

You can pay in one of two ways:

The order total includes the price of your items and the delivery fee. If an M-PESA payment fails, you can try again from your order page. If you were charged but your order still shows as unpaid, contact us with your M-PESA receipt number and we will sort it out.

If the amount received does not match your order total, we will hold the order until we have checked it, and then complete it, adjust it or refund you.

7.Delivery

We deliver to the areas listed at checkout. Please give a complete address and a phone number that will be answered, because the delivery person may call you.

Delivery times we give are estimates, not guarantees. If nobody is available to receive the order, we may reschedule it, and we may cancel it if we cannot reach you.

8.Damaged or wrong items

Please check your order when it is delivered. If an item is wrong, missing or damaged by us, tell the delivery person at the door and we will replace it at no extra cost, or refund you.

Once you have accepted and confirmed your delivery, the goods are yours and we cannot take returns for items that were delivered correctly. This does not affect your rights under Kenyan consumer law.

If the site lets you post reviews or comments, they must be honest, based on your own experience, and free of abuse, hate, false claims and spam. We may remove any review at our discretion.

You keep ownership of what you post, but you allow us to display and use it on the site and in our marketing. Reviews are the opinions of customers, not of Central Mart. Ideas or suggestions you send us may be used by us without payment.

11.Our content

The Central Mart name, logo, design, text, images and software belong to us or our licensors and are protected by law. You may view the site and print pages for your own personal use. You may not copy or reuse our content for any commercial purpose without our written permission.

12.Privacy

We collect your name, email, phone number and delivery details so we can process your orders. We handle personal data in line with the Kenya Data Protection Act. Please read our Privacy Policy for details of what we collect, why, and your rights.

13.Links to other sites

The site may link to websites run by other people. We do not control them and are not responsible for their content or practices. If you follow a link, their terms and policies apply instead of ours.

14.Suspending accounts

We may suspend or close your account, or block access to the site, if you break these terms, give false information or misuse the service. You may ask us to close your account at any time. Closing an account does not cancel orders already confirmed.

15.Changes to the site

We may change, pause or stop any part of the site at any time. We aim to keep Central Mart running smoothly, but we cannot promise it will always be available or error-free, for example during maintenance or network problems.

16.Our liability

We take care in running Central Mart, but the site is provided “as is”. To the extent the law allows, we are not responsible for indirect or consequential loss, for interruptions outside our control, or for problems caused by third parties such as mobile networks or payment providers.

Nothing in these terms limits any rights you have under Kenyan law that cannot be limited, including your consumer rights. Where our liability is allowed to be limited, it will not be more than the amount you paid for the order concerned.

17.Governing law and disputes

These terms are governed by the laws of Kenya. If you have a complaint, please contact us first so we can try to resolve it. If we cannot agree, the dispute will be handled by the courts of Kenya.

18.General

These terms, together with our Privacy Policy, are the whole agreement between you and us about the use of the site. If one part is found to be unenforceable, the rest still applies. If we delay in enforcing a right, we do not lose that right. We are not responsible for delays or failures caused by events beyond our reasonable control.
